1. Provider and scope
Sperata is developed and provided by Andrii Pokatylo, an individual developer. In these Terms, “Sperata” means the iPhone app, Apple Watch companion, widgets, Live Activities and the optional Sperata Pro subscription features.

These Terms apply wherever Sperata is lawfully made available. Availability in one App Store country or region does not promise availability in every country, language, device or operating-system version.
2. Agreement and Apple terms
Review these Terms before using Sperata or purchasing Sperata Pro. If you do not agree, do not use Sperata and do not purchase Sperata Pro. Where applicable law requires an express acceptance rather than notice, Sperata will ask for it separately.
Sperata is licensed through the Apple App Store, not sold. Apple's Standard Licensed Application End User License Agreement (“Apple Standard EULA”) continues to govern the licence to the app. These Terms add information and commitments about Sperata's own features, subscriptions and support; they do not replace or change the Apple Standard EULA. Apple's Media Services terms also apply to purchases made through the App Store.
Mandatory law applies regardless of these documents. Apple's terms govern its App Store, Apple Account, payment and refund services, and the Apple Standard EULA governs the app licence. These supplemental Terms describe the additional Sperata matters set out below without limiting rights under Apple's terms.
Sperata's Privacy Policy explains how information is handled. Agreeing to these Terms or purchasing Pro is not consent to process contraction information. Where separate privacy consent is required, Sperata asks for it separately.
3. Who may use Sperata
You must be legally capable of agreeing to these Terms. If the law where you live requires a parent or guardian to agree for you, use Sperata only with that person's permission and supervision. Sperata is not designed as a service for children.
Sperata is intended for personal, non-commercial use. It is not intended for use by a hospital, maternity unit, clinician, emergency service or another organisation as a medical record or clinical system.
4. Purpose and medical limitation
Sperata is a self-tracking and comfort tool. It records the start and end taps you make, calculates durations and start-to-start intervals from those entries, stores an optional intensity rating you choose, and displays descriptive history, summaries and charts. Its optional breathing exercises provide visual pacing only.
Sperata is not intended to medically monitor a person or to clinically assess, diagnose, prevent, predict or treat any medical condition. It does not determine whether labour has started, how labour is progressing, whether a pattern is normal or when you should seek care. Values shown by Sperata are mathematical descriptions of user-entered records, not clinical measurements or recommendations.
Do not use Sperata to make or delay a decision about care. Follow guidance from your midwife, maternity unit, doctor or another qualified healthcare professional. Contact an appropriate healthcare professional or emergency service if you are concerned about your health, pregnancy or baby.
5. How records and calculations work
Sperata relies on your taps, entries, device clock and supported Apple system services. A contraction duration is calculated from the recorded end time minus the recorded start time. An interval is calculated from the start of one contraction to the start of the next selected contraction in the same recorded session. Sperata does not join records that belong to different explicitly recorded sessions.
You are responsible for reviewing your entries. Interruptions, delayed taps, incorrect device time, an unavailable device, an operating-system restriction or failed synchronisation can make a record incomplete or inaccurate. Do not treat a missing notification, Watch update, widget, Live Activity or chart as a medical signal.
Your contraction records remain your information. Andrii does not acquire ownership of them merely because you use Sperata.
Sperata does not require a Sperata account. An Apple Account may be required to download the app, purchase or manage Sperata Pro, and restore an eligible subscription.
6. Free features and Sperata Pro
The current free experience includes the core iPhone timer, optional intensity entry, History and Insights for the latest five saved contractions, iPhone breathing exercises, supported iPhone widgets and Live Activities, deletion of all contraction data, and a machine-readable JSON copy of all saved contraction records and any active contraction currently stored on the iPhone. The exact interface can depend on the supported device and operating system. Older saved records are not deleted merely because the free interface shows the latest five.
Sperata Pro currently unlocks:
- visibility of all saved contraction history rather than only the latest five entries, including individual deletion, intensity editing and any correction control that Sperata specifically makes available for an anomalous record;
- creation of an on-device PDF report;
- insight ranges and summaries across all selected saved data; and
- the Apple Watch companion, including its timer, optional intensity entry, up to 12 recent records, breathing exercises and supported complications.
The weekly and monthly plans unlock the same Pro features. They differ only in their subscription duration and the price shown by Apple. A compatible iPhone, Apple Watch, operating-system version, paired-device setup and connectivity may be required for Watch features. An eligible Pro subscription is not a promise that every feature will work on unsupported hardware or software.
Sperata does not sell a separate Watch subscription. The supported Watch companion uses the eligible Sperata Pro entitlement associated with the supported iPhone/App Store purchase flow. This statement does not promise Apple Family Sharing, which applies only if Apple shows the specific subscription as shareable.
7. Auto-renewable subscriptions
Sperata Pro is offered through two Apple-managed auto-renewable subscription options:
- Sperata Pro Weekly: one-week subscription period; and
- Sperata Pro Monthly: one-month subscription period.
Before you confirm a purchase, Sperata and Apple's purchase sheet show the selected plan, its duration and the price applicable to your App Store storefront. The price in Apple's final purchase-confirmation interface is the price that applies to that transaction. Prices can vary by country or region and can include applicable taxes. Test prices used during app development are not promises of a production price.
Apple charges or authorises payment through its purchase flow and Apple Account. Unless you cancel before the renewal date, the subscription automatically renews for another period of the same duration and Apple charges the price applicable to that renewal. A pending purchase does not unlock Pro until Apple confirms an eligible entitlement. No free trial, introductory price or discount applies unless Apple clearly displays that offer before you confirm the purchase.
Apple supplies the billing, renewal and price-change flow and requests any consent its rules require for a price increase. This does not remove Andrii's obligations as the app provider. If a new price would apply, you can review the notice and cancel before renewal. Andrii does not receive your full payment-card details.
You can manage or cancel an Apple-billed subscription from Sperata's “Manage subscription” action or in your Apple Account subscription settings. Cancellation normally stops future renewal. An eligible Pro entitlement generally continues until the end of the already-paid period unless Apple refunds or revokes the transaction or applicable law provides otherwise. Use of features that process contraction data also requires the separate privacy choice described in section 9.
If you change between the weekly and monthly plans, Apple controls the timing, billing treatment and effective date of the change and shows the applicable details in its purchase or subscription-management interface.
Deleting Sperata, deleting contraction records, refusing or withdrawing privacy consent, or emailing Andrii does not cancel the subscription. When privacy processing is off, subscription management and Restore Purchases remain available, but Pro features that require contraction data cannot operate.
“Restore purchases” asks Apple to re-check eligible App Store entitlements. It does not create a new purchase and cannot restore an expired, refunded, revoked or ineligible subscription. It does not restore contraction records or exports that were deleted from your devices.
Sperata recognises an eligible, verified entitlement reported by Apple, including an active grace period if Apple reports one. Temporary Apple service, network or entitlement-verification problems may delay access. Where Sperata fails to provide a paid feature, contact support and retain any rights you have under applicable law.
8. Refunds and statutory rights
Apple processes App Store payments and refund requests. You can request an eligible refund through reportaproblem.apple.com or contact Apple Support. Refund eligibility and consequences are determined by Apple and the consumer law that applies to you.
Nothing in these Terms removes or limits a cancellation, refund, repair, replacement, repeat-performance, price-reduction or other right that cannot lawfully be excluded. Contact Andrii as well if your request concerns Sperata's performance rather than Apple's billing system.
Cancelling automatic renewal is different from exercising any statutory withdrawal or cooling-off right, requesting a refund, and withdrawing the privacy choice described in section 9. The availability and effect of a statutory withdrawal or cooling-off right depends on the law and purchase flow that apply to your transaction.
9. Privacy choice and withdrawal
Sperata asks separately before processing contraction start and end times and optional intensity ratings for the timer, history, insights, Apple Watch, widgets, Live Activities and exports. You may refuse that choice. You may later withdraw it through Settings.
Withdrawal stops the covered processing and starts Sperata's deletion process as described in the Privacy Policy. It does not cancel an Apple subscription, recall an export you already shared or immediately reach an offline Apple Watch.
10. Exports and sharing
Sperata can create a free machine-readable JSON data copy and, with Pro, a PDF report. Both are generated only after your action and can contain sensitive pregnancy-related information.
You choose whether and where to share an export. Check the destination and recipient before sharing it. After an export leaves Sperata, the recipient, storage provider or other selected service controls its copy under its own terms and privacy practices. Sperata cannot automatically retrieve or delete a copy held by you or another recipient. A recipient, including Andrii if you send an export to support despite the warning in section 15, is responsible for the copy it receives under applicable law and its stated practices.
11. Your responsibilities
You agree to:
- use Sperata only lawfully and for its intended personal purpose;
- protect access to your iPhone, Apple Watch, widgets, Live Activities and exports;
- review entries instead of assuming they are complete or clinically accurate; and
- maintain compatible software and follow reasonable security updates where needed for continued operation.
You must not interfere with Sperata or Apple services, bypass purchase or access controls, distribute unauthorised copies, use the app to infringe another person's rights, or reverse engineer the app except where applicable law or an applicable open-source licence expressly permits it.
12. App updates and availability
Andrii may update Sperata for security, privacy, accessibility, legal, compatibility or product-improvement reasons. A supported operating-system update may be required. Free interfaces and features may evolve, but changes will not remove rights that applicable law gives you.
Andrii will provide the Pro features advertised when you purchased them during the applicable paid period. A paid feature will not be removed or materially reduced during that period except for a valid security, privacy, legal or compatibility reason and only through a process permitted by applicable law. Such a change will not add a charge, and Andrii will provide advance notice and an applicable remedy or termination right where the law requires one.
Sperata, Apple services and device-to-device communication may sometimes be unavailable because of maintenance, outages, compatibility changes or events beyond reasonable control. No uninterrupted or error-free operation is promised.
13. Intellectual property
Sperata's software, interface, graphics, text and branding are owned by Andrii or their respective licensors and are protected by applicable intellectual property law. The Apple Standard EULA gives you a limited licence to use the app. These Terms do not transfer ownership of Sperata or permit you to use its branding as your own.
Third-party or open-source components, if any, remain subject to their own licences.
14. Apple and external services
Apple is responsible for the App Store, Apple Account, StoreKit, subscription management and Apple-controlled payment services. Apple may also provide device backup, diagnostics and other platform services under its own terms and privacy information.
Sperata may open an external email app or Apple webpage after you choose a support, legal, subscription-management or refund action. Andrii does not control the availability or content of those external services.
15. Support
Support is available at Gudviktorovich@gmail.com. Support is not an emergency or clinical service and cannot interpret contraction records or advise when to seek care.
Do not include contraction records, PDF or JSON exports, medical records, or information about your health, pregnancy or baby in a support email. Describe technical problems without sensitive details where possible.
16. Quality, warranties and consumer protections
Andrii will provide Sperata with reasonable care and skill and will take reasonable steps to keep the released app consistent with its description. However, device software can contain defects and depends on Apple hardware, operating systems and services that Andrii does not control.
Except for rights and warranties that cannot lawfully be excluded, Sperata is provided without a promise that it will always be available, compatible with every device, preserve every local record or meet a medical or clinical need. The warranty provisions in the Apple Standard EULA also apply to the app licence, subject to applicable consumer law.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence, or your non-excludable statutory consumer rights.
If Andrii fails to comply with these Terms, he is responsible for loss or damage that is a foreseeable result of that failure or of a failure to use reasonable care and skill, subject to applicable law. Andrii is not responsible for loss that could not reasonably have been foreseen when you agreed to these Terms, or to the extent a loss was caused by inaccurate user entries, unsupported use, or an Apple or third-party service outside his reasonable control.
Sperata is supplied for personal use. To the extent permitted by law, Andrii is not responsible for business losses, lost profit, lost business, business interruption or lost business opportunity arising from consumer use of the app.
The medical limitations in section 4 are important, but they do not exclude any liability that applicable law does not allow Andrii to exclude.
18. Ending use and access
You may stop using Sperata at any time. You may delete local contraction data, withdraw privacy consent and remove the app using the available app and Apple device controls. These actions do not by themselves cancel a subscription; use Apple's subscription settings for cancellation.
The Apple Standard EULA explains when the Apple app licence terminates. A Pro entitlement also ends when Apple reports it as expired, refunded, revoked or otherwise ineligible. Separately, Andrii may restrict access for a material breach of these Terms. Where reasonable and lawful, Andrii will give notice and an opportunity to correct that breach before restricting a paid feature. This does not limit action needed immediately to protect users, Apple services, security or legal compliance.
Sections that by their nature continue after you stop using Sperata—including intellectual-property, payment, disclaimer, liability and dispute provisions— continue only to the extent applicable and lawful.
19. Changes to these Terms
These Terms may be updated for a valid reason, such as a change to Sperata, Apple requirements, security, law or the identity of the provider. The effective date and version at the top identify the current text.
Material changes will be explained through a clear in-app notice before they take effect whenever applicable law requires notice to an active user. A change will not retroactively remove a right you already have or alter an already-paid period where applicable law requires your express agreement. Continued use will not be treated as express agreement where the law requires a separate action. If you do not agree to a future change, you may stop using Sperata and prevent another subscription renewal through Apple.
If Sperata is later provided by a company or transferred to a successor, the provider identity and public legal documents will be updated. Any transfer of these Terms will not reduce your mandatory rights or the paid benefits already promised for an active subscription period.
20. Applicable law and disputes
The Apple Standard EULA states the law and forum that apply to the app licence. For matters governed by these supplemental Terms, the mandatory consumer law and courts available in your country of habitual residence remain available where they cannot lawfully be excluded. These Terms do not require mandatory private arbitration or prevent you from contacting a competent consumer or regulatory authority.
Please contact Andrii first at Gudviktorovich@gmail.com so there is an opportunity to resolve a problem informally. This does not delay or replace a legal deadline or remedy available to you.
If any provision is found invalid or unenforceable, the remaining provisions continue to the extent they can lawfully operate. A failure to enforce a provision immediately is not a waiver of it.
